品格证据在婚姻纠纷诉讼中的适用研究

摘　　要：和谐婚姻是构建和谐社会的重要因素,面对司法实践中多发的婚姻纠纷诉讼,引入品格证据,发挥其潜在优势,有助于提升事实认定真实性、保障当事人权利以及弘扬正确家庭观。基于我国目前面临的相关品格证据立法领域缺失、审判者自由裁量权规制以及当事人隐私保护等挑战,探讨合理构建婚姻纠纷诉讼中品格证据适用的路径具有重要意义。品格证据适用于婚姻纠纷诉讼,应明确目标,注重遵循合法性、客观性、保密性和教育性原则,划定品格证据的适用范围,明晰取证形式和采信标准,采用直接适用和间接适用相结合的方法,推动构建具有中国特色的婚姻纠纷审理模式。Harmonious marriage is an important factor in the construction of a harmonious society. In the face of multiple marital dispute lawsuits in judicial practice, introducing character evidence and giving play to its potential advantages can help to improve the authenticity of fact determination, protect the rights of parties and promote correct family values. Our country is facing challenges: the deficiency of related character evidence legislation, the regulation of judicial discretion and privacy protection of litigator. It is necessary to explore the applicable paths of character evidence to construct reasonably. Character evidence applied to marriage dispute litigation should be clear of the objective,pay attention to follow the principles of legality, objectivity, confidentiality and education. At the same time, delimit the scope of application of character evidence, clarify the form of evidence collection and admissibility standards, and adopt the method of combining direct application and indirect application. This is helpful to promote the construction of marriage dispute trial mode with Chinese characteristics.
