政府“败诉”视角下的行政审判助力依法行政研究——基于一个地方法院的样本分析

摘　　要：判决行政机关“败诉”,通过“司法否决”的方式让具有问题和瑕疵的行政行为回归正轨,从本质而言有助于政府依法行政。通过对池州市中级人民法院的田野调查发现,目前地方法院判决政府“败诉”行政案件的进步性主要表现为大胆运用推理技术、追求法的实质正义,适当进行法理解析、适法解理双轮驱动,尊重日常生活法则、裁判观点契合实际,准确把握裁判尺度、有力确保利益衡平,充分考虑客观实际、高度体现司法温度,厘清合法违法边界、精准裁判案件等六个方面。但亦存在“审理一案、教育一片”意识有待提升、司法建议制度尚未充分发挥应有效能和行政机关“败诉”案件中负责人出庭率较低等问题,未来应有的放矢地优化之。In essence,it is helpful for the government to administrate according to law by judging the administrative organ“losing the lawsuit”and making the wrong administrative act return to the right track by the way of“judicial veto”.Through the field investigation of Chizhou intermediate court,we find that the progress of the local court's judgment on the administrative cases of“losing the lawsuit”of the government is mainly manifested in the following aspects:boldly using reasoning technology to pursue the substantive justice of law;properly analyzing the legal theory,the judgment has a certain level of quality;respecting the law of daily life,the judgment viewpoint is in line with the reality;preparing to grasp the judgment scale and effectively ensure the interests There are six aspects:interest balance;full consideration of the objective reality,the judicial temperature of the judgment;clarifying the boundary of legal violation and accurate judgment of cases.However,there are still some problems,such as the consciousness of“hearing a case,educating one piece”,the judicial suggestion system has not been brought into full play,and the attendance rate of the person in charge in“losing”cases of the administrative organ is low,which should be optimized in the future.
