摘  要:学习权是构建终身学习体系与学习型社会的权利基础与逻辑起点。本文基于整体意义的方法框架,运用比较分析、概念分析和规范分析等方法,论证学习权的基本权利属性及其规范价值。分析结果表明,鉴于我国宪法并无明文规定,学习权的基本权利属性需要运用宪法规范的整体意义脉络这一分析框架方可证成。概括性人权条款为学习权提供了价值基础和语义空间,基本权利规范体系为学习权提供了规范基础和意义空间。学习权作为一项宪法基本权利,需要构建包括基本权利和具体权利类型在内的子权利体系,建立基于国家履行尊重义务、保护义务与给付义务的立法、行政和司法等层面的保障制度,确立相应的推理规则,为学习权实现提供了理论、制度与方法论基础。The right to learn is the right basis and logical starting point for building a lifelong learning system and a learning society.Based on the method framework of the overall significance,this paper demonstrates the basic right attribute of the right to learn and its normative value by means of comparative analysis,conceptual analysis and normative analysis.The results show that,since there is no explicit provision in the Constitution of China,the basic right attribute of the right to learn can only be proved by using the analytical framework of the overall significance of the constitutional norms.The general human rights clauses provide the value basis and interpretation space for the right to learn,and the basic rights normative system provides the normative basis and significance space for the right to learn.As a basic constitutional right,the right to learn needs to build a sub right system including basic rights and specific types of rights,establish a legislative,administrative and judicial security system based on the state's obligations of respect,protection and payment,and establish corresponding reasoning rules,which provides a theoretical,institutional and methodological basis for the realization of the right to learn.
