达特茅斯学院案裁决对美国高等教育治理模式的影响

摘　　要：达特茅斯学院案裁决的核心意义是彰显了契约的神圣特性,从而奠定了高等教育治理的法律基础,保障了高等教育多元发展,澄清了高等教育机构性质,厘清了政府与大学的基本法律关系,在大学自治和政府控制之间形成了合理的平衡,为美国寻求适合其社会政治、经济和文化环境的高等教育治理模式创造了条件。虽然中国与美国国情不同,高等教育发展模式相异,但该裁决的核心意义对中国高等教育治理仍具有一定的启示作用。The core significance of the Dartmouth case adjudication shows that it highlights the sacred character of contract,thus laying the legal foundation of higher education governance,guaranteeing the diversified development of higher education,clarifying the nature of higher education institutions,clarifying the basic legal relationship between government and university,and forming a reasonable balance between university autonomy and government control.It creates the conditions for the United States to seek higher education governance model suitable for its socio-political,economic and cultural environment.Although China and the United States have different national conditions and different development modes of higher education,the core significance of the adjudication still has some enlightenment for China's higher education governance.
