企业数据权益的理论表达及其保护路径

摘　　要：[目的/意义]数据权益保护是实践探讨的重要议题,正确理解数据权益的理论意蕴,构建合理的数据权益保护模式是保障企业利益、促进数字经济发展的制度基础。[方法/过程]通过文献分析、比较分析方法,文章反思了当前学界提出的企业数据权益保护理论,指出了各种理论对数据特征和保护语境的忽视,难以为数据权益保护和数据充分利用提供理论支撑。[结果/结论]数据在线上线下语境中具有不同含义,在载体、符号和内容层面具有不同的内涵,同时数据的信息内容也存在差异,应当对数据的不同内涵进行区分,针对不同的信息内容构建保护制度。而在具体模式上,可以采取公法与私法协同、权利化与行为规制结合的方式保护企业数据权益。[Purpose/significance]The protection of data rights and interests is an important topic discussed in practice.A correct understanding of the theoretical meaning of data rights and interests and a reasonable model of data rights and interests protection are the institutional basis for protecting the interests of enterprises and promoting the development of the digital economy.[Method/process]Through literature analysis and comparative analysis,this paper reflects on the theory of enterprise data rights and interests protection proposed by the current academia,and points out that various theories ignore data characteristics and protection context,so it is difficult to provide theoretical support for data rights and interests protection and full use of data.[Result/conclusion]Data has different meanings in the online and offline context,and has different connotations in the carrier,symbol and content levels.At the same time,the information content of data also has differences.Therefore,different connotations of data should be distinguished and a protection system should be built for different information content.In terms of specific models,we can protect the data rights and interests of enterprises by combining public law with private law,and by combining rights with behavior regulation.
