摘　　要：[研究目的]加拿大“情报-诉讼证据”转化模式是为应对情报信息秘密性与诉讼证据公开性的固有冲突而设,对其发展沿革及历史经验进行探究,有利于完善、解决我国情报信息与诉讼证据转化问题,保障国家安全与公民权利。[研究方法]通过网络调研法,梳理加拿大“情报-诉讼证据”转化问题的发展沿革、实践进路、总结出情报信息转化过程中的措施以及对我国应对情报信息转化的可资借鉴之处。[研究结论]加拿大“情报-诉讼证据”转化在一定程度上解决了公民对权利保障以及国家机构对情报信息保护的需求。我国应当积极借鉴经验通过设置合理的情报信息披露规则、完善的情报信息庭前开示程序、提升检察机关监督建议权效用等缓解“情报信息”与“公民权利”的矛盾。[Research purpose] Canada's "information litigation evidence" transformation model is set up to deal with the inherent conflict between the confidentiality of information and the openness of litigation evidence.Exploring its development and historical experience is conducive to improving and solving the transformation of information and litigation evidence in China,and ensuring national security and civil rights.[Research method] Through the method of network research,this paper reviews the development and practice of the transformation of "intelligence litigation evidence" in Canada,summarizes the measures in the process of intelligence information transformation,which is a reference for China to deal with intelligence information transformation.[Research conclusion] The transformation of "intelligence litigation evidence" in Canada meets the citizens' needs of the protection of rights and national institutions for the protection of intelligence and information to a certain extent.China should actively learn the experience,alleviate the contradiction between "intelligence information" and "civil rights" by setting reasonable rules for information disclosure,strictly review procedures for information that is not suitable for disclosure,and promote special lawyer agency system.
