摘 要:国家教育考试法的缺位是教育法治建设中的一大难题。在教育法典编纂进程中,是否设置以及如何设置“教育考试编”,应从法教义学层面加以厘清。理论上,设置“教育考试编”与教育法典的体系化功能相契合,有助于凝聚考试法治建设的理论与实践共识,也是考试立法取得实质性突破的关键一招。“教育考试编”宜将权力约束、权利保障和秩序维护作为法理根基,采用总分式体例构造,以考试流程为逻辑线索,并在原则上将规制范围限于国家教育考试领域。在具体立法进程中,应实现对既有考试法律法规的体系性整合,重视教育法典内部的体系衔接,回应考试执法与考试司法实践中的争议问题,采用专家立法与公众参与相结合的程序路径。The absence of a national education examination law is a major problem in constructing the rule of law in China's education.In the process of compiling the education code,whether and how to set up the education examination section should be clarified from the perspective of jurisprudence.From a theoretical point of view,establishing the education examination section is consistent with the education code's systematic function and helps reach a theoretical and practical consensus on the construction of the examination rule of law.It is also a key move for the substantive breakthrough of the examination legislation.The education examination section should take power restriction,rights guarantee and order maintenance as the legal basis,adopt the deduction style structure,take the examination process as the logical link,and limit the scope of regulation to the national education examination field.In the specific legislative process,we should systematically integrate the existing examination laws and regulations,pay attention to the internal system connection in the education code,address the controversial issues in the examination law enforcement and its judicial practice,and follow the procedural path of combining expert legislation and public participation.
