摘  要:回归祖国后,我国香港特区对教育考试执法进行了一系列改革,建立了融统一领导与监督制衡于一体的教育考试执法制度,取得不少成绩,如建立教育考试执法组织架构,构筑教育考试处罚种类体系,强化教育考试执法程序,完善教育考试执法复核监督机制。其经验可概括为:专业化复核监督体系是提升考试执法水平的组织保障,递进式考试处罚种类体系是彰显慎罚精神的制度保障,严密的考试执法程序是确保结果公正的实施保障。这些经验对于内地规范教育考试执法、提高考试法治化水平具有借鉴价值。After its return to the motherland,China's Hong Kong Special Administrative Region has carried out a series of reforms on the law enforcement of educational examination and formed an educational examination law enforcement system and mechanism integrating"unified leadership,supervision and balance".The achievements are as follows:the establishment of a relatively unified organizational structure for education examination law enforcement,the construction of a rigid and flexible classification system for education examination punishment,the strengthening of the practical application of procedures in education examination law enforcement,and the improvement of a multi-level review and supervision mechanism for education examination law enforcement.The experience can be summarized as follows:a professional review and supervision system is the organizational guarantee to improve the level of examination law enforcement,a progressive classification system of education examination punishment is the institutional guarantee to demonstrate the spirit of cautious punishment,and strict procedures of education examination law enforcement are the implementation guarantee to ensure fair results.These experiences are valuable for standardizing the law enforcement of educational examinations and improving the level of law-based examination governance in the mainland of China.
