摘　　要：宅基地分配是集体经济组织成员以户为单位原始取得宅基地使用权的程序。基于宅基地社会功能的多元性和特殊性,宅基地分配制度的结构体系呈现出复合性。我国当前的宅基地分配面临着诸多困境。应该从宅基地分配的基本原则、逻辑主线和制度设计三个层面构建和优化其制度体系。应坚持市场化配置和适度管控结合、政府管理和成员自治结合及因地制宜推进改革的基本原则。宅基地分配制度改革要注意私权利和公权力配置的平衡,优化一户一宅、无偿分配制度,探索宅基地“三权分置”制度和完善宅基地分配程序制度。Homestead allocation is a procedure for members of collective economic organizations to obtain the right to use homestead in the original way.Based on the diversity and particularity of the social functions of the homestead,the structural system of the homestead distribution system is complex.China's current homestead allocation is facing many difficulties.We should construct and optimize the system from three aspects:the basic principles,the main logic and the system design.We should adhere to the basic principles of combining market-oriented allocation with appropriate management and control,combining government management with member autonomy,and promoting reform according to local conditions.The reform of homestead distribution system should pay attention to the balance of private rights and public power allocation,optimize the distribution system of"one household,one house"and free of charge,explore the system of"Three Rights Separation"of homestead and improve the homestead distribution procedure system.
