中医药传统知识的知识产权“特殊保护”文献价值分析

摘　　要：国内外越来越重视传统医药知识的保护,部分发展中国家在加强立法。新近以来,中国也在积极应对,不论是立法导向,还是学术研究,莫不同向发力。通过中医药传统知识文献梳理,分析得出中医药传统知识特殊保护的国内文献价值体现在四条明显的发展路线以及研究途径,即观望路线,分类路线,融合路线和技术路线。中医药传统知识特殊保护的国外外文文献价值具有四大要点,即吸引力、自成一体、数据库数字资源和话语权,体现了传统医药知识传承与保护的双重任务的时代特征。梳理国内外文献价值分析对中医药传统知识的知识产权特殊保护制度体系构建具有重要意义,契合了提升国家治理体系和治理能力现代化及推进全面依法治国的理念内涵。As domestic and foreign countries are paying more and more attention to the protection of traditional medical knowledge,some developing countries are strengthening their legislation.Recently,China has also been actively responding to it in different directions,both in terms of legislative orientation and academic research.Through combing the literature of traditional knowledge of Chinese medicine,we analyze and conclude that the value of domestic literature on special protection of traditional knowledge of Chinese medicine is reflected in four obvious development routes as well as research paths,namely:the watch route;the classification route;the integration route;and the technology route.The value of foreign foreign literature for special protection of traditional knowledge of TCM has four major points,namely:attractiveness;self-contained;database digital resources;and discourse,which reflects the characteristics of the times of the dual tasks of traditional medicine knowledge transmission and protection.The analysis of the value of the literature at home and abroad is of great significance to the construction of the system of special protection of intellectual property rights for traditional knowledge of Chinese medicine,which is in line with the connotation of enhancing the modernization of the national governance system and governance capacity,and promoting the comprehensive rule of law.
