摘　　要：收买被拐卖妇女、儿童的社会问题由来已久,长期以来未能得到有效遏制。从整个刑法体系的罪刑设置来看,收买被拐卖的妇女、儿童罪的法定刑过低,既与我国其它罪名的刑罚设置不相协调,也未能与其他发达国家地区以及国际上重视人性尊严和弱势群体权益保障的理念相接轨。从司法运行中的刑罚适用情况来看,对于收买方的处罚不力以及礼制传统观念在思想层面的推波助澜均是造成收买被拐卖妇女、儿童犯罪治理困境的现实成因。收买被拐卖妇女、儿童犯罪的有效治理,需要在刑事法律内外进行立体化与综合性的施策应对。收买被拐卖妇女、儿童问题的有效化解,需要回归犯罪生成的社会机理层面进行对症下药,通过事前堵截与综合施策的方式,最大程度地预防和减少此类行为的发生。buying abducted women and children has long been a social problem yet has not been effectively contained for a long time.In terms of penalty configuration of the entire criminal law system,the legal punishment for the crime of buying abducted women and children is too lenient,which is not coordinated with legal punishment of other crimes in China,nor in line with the concept of valuing human dignity or protecting the rights and interests of vulnerable groups in other developed countries or regions as well as the international community.Judging from the application of penalty in judicial operation,more lenient punishments to the buyer and the ideological promotion of the traditional concept of ritual practically cause the dilemma in the management of buying abducted women and children.The effective governance of the crime of buying abducted women and children needs multidimensional?and comprehensive measures both inside and outside the criminal law.To effectively solve the problem of buying abducted women and children,it is necessary to return to the social mechanism of crime generating to prescribe the proper medicine,and prevent and reduce uch behaviors to the greatest extent by means of pre-blocking and taking comprehensive measures.
