摘　　要：在老龄化日益被重视的新时代背景下,老年法学逐渐成为一门重要的新兴学科。但是在不同学科中,对于老年法学的基础内涵和范围特征的研究几乎空白,具有研究的急迫性和必要性。笔者认为,老年法学是研究以涉老法律为核心、涉老法律现象和因人口老龄化的法律现象的法学分支内容。缘于老年法学是针对一类制度事实和结果科学研究型态,这种型态的存在和发展是老年法学本身具有的应然性,这种法学的应然性是其内在的合理性,并且是它真正获得学术生命力的凭依,它能够经受学科学和法学对其进行的资格检视;因为老年法学能够回答社会的老龄化与法律、法学涉老法律现象之问,以及促进涉老法律不断发现、不断发展的社会意义,而且从它所具有的“这样的”内在和型态出发,老年法学具有“法学可欲”内容、法律实用价值。Under the background of the new era that aging has been paid more and more attention,the law of elder has gradually become an important new science.However,in the research of different disciplines,the basic connotation and scope characteristics of elder law are almost blank,which makes it urgent and necessary o study.The author thinks that the law of old age is a branch of law which studies the law concerning the old as the core,the legal phenomenon conceming the old and the legal phenomenon due to the aging of the population.Origin from that geriatric law is scientific research type aiming at a class of institutional facts and results,the existence and development of this lype is the necessity of the law of the elderly itself,which is its inherent rationality and the basis for its.true academic vitality.It can withstand the qualification examination of science and law;It is also because the law of the elderly can answer the questions about the aging of sociely and the phenomenon of law involving the elderly,and promote the social significance of the continuous discovery and development of the law involving the elderly.Moreover,it has the"such"intrinsic and type,and the law of the elderly has the content of"law can be desired"and the practical value of law.
