摘 要:建造人对违法建筑不享有所有权,而享有占有利益。考虑到司法实务中已经承认对违法建筑的强制执行,以及社会现实已经广泛承认违法建筑的使用价值,故应当肯定违法建筑的转让效力,承认受让人的占有利益。建造人、受让人对违法建筑的占有利益不受强制执行的不当侵害。鉴于《民事诉讼法解释》将案外人异议之诉的异议事由界定为权利和利益,故应当允许建造人、受让人基于对违法建筑的占有利益提起案外人异议之诉,寻求执行救济。The builder does not enjoy the ownership of the illegal building, but enjoys the possession interest.Considering that the enforcement of illegal buildings has been acknowledged in judicial practice and the use value of illegal buildings has been widely recognized, the transfer effect of illegal buildings should be affirmed and the assignee’s possession interest should be recognized. The possession interest of the constructor and the assignee for the illegal building shall not be infringed improperly by compulsory execution. Whereas the Interpretation of the Civil Procedure Law defines the cause of objection of the third party objection action as rights and interests, the constructor and the assignee should be allowed to file the third party objection action based on the possession interest of the illegal building to seek relief.
