论案外人执行异议之诉的管辖法院

摘　　要：因案外人执行异议之诉的审理是围绕特定执行标的物展开的,且与执行程序存在较强的牵连关系,故宜由特定执行标的物所在地的执行法院专属管辖,且无论特定执行标的物上是否存在轮候查封以及执行案件是否被委托、提级或指定执行。根据《民事诉讼法》第二百三十一条、《民诉法解释》第三百零二条的规定,不与被执行的财产所在地或者说执行标的物所在地法院重合的一审法院、被执行人住所地法院作为执行法院时,案外人执行异议之诉由执行法院管辖的性质并不属于专属管辖。未来的《民事强制执行法》应当以应执行之标的物所在地或应为执行行为地为首要标准确定执行案件的管辖法院,进而将案外人执行异议之诉的管辖法院限缩为特定执行标的物所在地的执行法院。Because the hearing of the execution of dissenting lawsuit by the outsider is carried out around the specific subject matter of execution,and there is a strong implicated relationship with the execution procedure,it is appropriate to be under the exclusive jurisdiction of the enforcement court where the specific subject matter of execution is located,regardless of whether there is a seizure on the subject matter of a particular execution and whether the execution case is entrusted,promoted or designated for execution.According to Article 231 of the Civil Procedure Law and Article 302 of the Interpretation of the Civil Procedure Law,when the court of first instance which does not coincide with the court of the place where the property is executed or the place where the subject matter of execution is located,or the court of the domicile of the person subject to execution serves as the enforcement court,the nature of the execution of dissenting lawsuit by outsiders under the jurisdiction of the enforcement court does not belong to the exclusive jurisdiction.The future Civil Enforcement Law should determine the jurisdiction court of the execution case based on the location of the subject matter to be executed or the place where the execution act should be carried out,and then limit the competent court of the execution of the dissenting lawsuit by the outsider to the enforcement court of the place where the specific subject matter of execution is located.
