大都市郊区农户宅基地流转退出倾向及改革路径——基于上海奉贤区3100户农户的调查分析

摘　　要：研究大都市郊区宅基地流转退出的倾向及其改革路径,具有重要的前瞻性引领借鉴意义。本文基于上海158个村3100农户的调研数据,运用2-模网等方法,研究了农户政策选择的倾向性及其影响因素。研究发现,宅基地上房屋面积的保障权属是农户最关注的权利,“纯粹等面积”置换政策组最受欢迎,人口结构特征对其有着显著影响;农户更关心流转退出宅基地上的房屋面积是否受损,不太关心流转退出宅基地所有权是否仍归属集体所有;宅基地用益物权缺失增加了农户对财产权丧失的顾虑,“股份分红”政策组被接受度最低。农户的政策选择倾向性表明:法律层面的进一步明确,改革的重点突破与整体推进,产权体系的调整等,是适应新发展阶段目标要求的改革路径。The challenge facing current agricultural land reform is the confirmation and transfer of homestead.From the perspective of policy design,this paper integrates 11 homestead transfer policy factors into an instrument of 13 policy options.The paper uses data collected from a policy selection household survey on 3100 rural households in 158 villages,Fengxian District,Shanghai.The paper uses 2-model network to study the impact of rural household characteristics on their policy preferences concerned with the homestead's living security and property attributes.The study finds that the protection of the homestead ownership is farmers'most concerned rights;the"equivalent area"is the most popular one among all policies,the collective ownership of homestead is less concerned,and households'characteristics significantly affect policy selection.The lack of usufructuary rights on homesteads has increased farmers'concern about property right loss,and the"dividend"policy package is the least accepted.The survey results clearly show that lack of usufructuary rights brings resistance to the homestead circulation.It is required that theoretical innovation and breakthrough of land policy are clarified by law to clear up farmers' concerns and achieve development goals.
