摘　　要：方法论与学科相互影响,新的方法论的使用能够促进新的学科的形成。跨学科的研究方法和理论已成为当下学术研究的新趋向。敦煌法学是一门使用跨学科的研究方法与理论对敦煌及其相关法律文献进行考察,探究其中所包含的法的要素、思想、规范、制度、实践与精神的交叉学科,既是敦煌学的一个分支学科,也是法学的一个分支学科,有着丰富的社会基础、扎实的敦煌学和法学研究基础以及相对明确的研究对象和范围,形成了较为成熟的学术研究团队。敦煌法学的研究有助于促进当代中国特色社会主义法治话语体系、新文科新法学的建设。Methodology and discipline can interact each other.The use of new methodology sometimes can help new discipline grow up.Using multidisciplinary methods and theories is becoming more and more popular now.Dunhuang jurisprudence is an interdiscipline that explores the documents of Dunhuang with multidisciplinary methods and theories in order to study the legal elements,ideas,norms,systems,practice and spirit.It is a subdiscipline of Dunhuang studies and jurisprudence because of rich social foundation,solid foundation of Dunhuang Studies and legal research,and a relatively clear research object and scope,forming a relatively mature academic research team.It also has ripe academic bodies.The studies on Dunhuang jurisprudence can promote the levels of the construction of new jurisprudence and the socialist rule of law's discourse system with Chinese characteristics.
