法权理论视角下粤港澳大湾区高等教育治理结构法权特征及其优化

摘　　要：粤港澳大湾区面临高等教育治理主体及利益相关者法权关系复杂多元的现实。粤港澳高等教育治理结构的法权特征是:“政府主导+院校有限自主”“院校高度自治+多元共治”“院校自主办学+辅助监管”,三地高等教育治理运行存在自上而下垂直治理、多元平行共治和松散辅助监管的现实差异。粤港澳大湾区高等教育治理结构优化应基于法权场域、法权主体、法权关系、法权本质等方面来展开,具体包括:坚持“一国两制”框架下湾区高等教育治理,深化中央政府简政放权扩大湾区高校办学自主权,构建多元协同湾区高等教育治理机制,探索有限政府、有为高校、有效社会(组织)相结合,促进粤港澳大湾区高等教育形成更加深刻的共识和互信,为促进港澳融入国家发展大局奠定基础。The Guangdong-Hong Kong-Macao Greater Bay Area is faced with the reality of complex and diversified legal rights relations between the main body and stakeholders of higher education governance.The legal right characteristics of higher education governance structure in Guangdong,Hong Kong and Macao are respectively"government-led+institutions with limited autonomy","institutions with high degree of autonomy+multiple co-governance",and"institutions with independent education+auxiliary supervision".There are practical differences in the governance operation of higher education in the three places:top-down vertical governance,multiple parallel co-governance and loose auxiliary supervision.The optimization of higher education governance structure in Guangdong-Hong Kong-Macao Greater Bay Area,including the field of legal right,the subject of legal right,the relationship between legal right and the nature of legal right.It includes adhering to the governance of higher education in the Bay Area under the framework of"one country,two systems",deepening the central government's streamlining administration and delegating right to expand the autonomy of higher education in the Bay Area,and building a diversified collaborative mechanism for higher education governance in the Bay Area.To explore the combination of limited government,viable universities and effective societies(organisations),promote deeper consensus and mutual trust in the higher education sector of Guangdong,Hong Kong and Macao,and lay the foundation for integrating Hong Kong and Macao into the overall development of the country.
