刑事庭审安保二元规制:理论依据、现实困境与路径选择——基于川滇藏交界民族地区的考察

摘　　要：川滇藏交界民族地区位于我国西南边陲,囿于地形、地势、气候等诸多客观因素,该区域刑事法治建设呈现“半封闭”状态,亟需找寻合适路径加以完善。结合该区域实际,提出刑事庭审安保二元规制模式,兼顾了庭内安保与庭外安保,因此更能平衡、协调庭审、庭前两大场域聚焦的公平正义与秩序建构取向。在实践中又沿循公平正义需要依靠法庭这一平台输出的逻辑,坚持问题追溯、过程把控与目标映射相结合,能够准确地弥合庭内安保规制与庭外安保规制对公平正义这一目标实现作用不均衡的缺口,助推以审判为中心的刑事诉讼制度改革,真正实现庭审实质化,最终提升川滇藏交界民族地区的刑事审判质效。The ethnic groups inhabited regions at the border of Sichuan,Yunnan and Tibet are located in the southwest border of China.Limited by topography,topography,climate and other objective factors,the construction of criminal rule of law in this area is in a“semi-closed”state,and it is urgent to find appropriate ways to improve it.Combined with the actual situation in this region,the dual regulatory approach of criminal court security is proposed,taking into account both in-court security and out-of-court security.Therefore,it will better balance and coordinate the orientation of fairness,justice and order construction focusing on the two fields of trial and pre-court.In practice,following the logic platform of the need to rely on the court justice output and adhering to the combination of problem tracing,process control and target mapping,can accurately bridge the gap between in-court security regulation and out-of-court security regulation in achieving the goal of fairness and justice,promote the reform of criminal proc edure system centered on trial,truly realize the materialization of trial,and finally improve the quality and efficiency of criminal trials in ethnic groups inhabited regions bordering Sichuan,Yunnan and Tibet.
