基于客体前置化的危险驾驶罪之罪过辨正研究

摘　　要：设立及修正危险驾驶罪名是风险社会下顺应交通安全需求的必然选择。学界对该罪的罪过类型的认识有犯罪故意说、犯罪过失说和混合说等观点。正确认识危险驾驶罪的犯罪客体是厘定其主观罪过的必要前提。在风险社会背景下,危险驾驶罪的犯罪客体应理解为关乎公共安全的交通秩序,而非公共安全本身。在事实层面,危险驾驶行为人对危害公共安全和违反交通秩序所持的主观心态并不一致。在规范层面,危险驾驶行为人明知违反了交通秩序并对此持有希望或放任的意志态度时,才符合危险驾驶罪的主观要件,故其罪过形式只能是犯罪故意。本罪与其他危害公共安全类犯罪的罪间关系为法条竞合关系,在出现法条竞合情形时,根据行为人对公共安全的主观罪过内容确定相关罪名,对其从一重处。Establishing and amending the crime of dangerous driving is an inevitable choice to meet the needs of traffic safety in the risk society.The understanding of the subjective types of this crime in the academic circle generally include criminal intent,criminal negligence,and mixed theory,but these views all have their inherent defects.A cor-rect understanding of the criminal object is a necessary prerequisite for determining its subjective guilt.In the context of the risk society,the object of the dangerous driving crime should be interpreted as the traffic order related to public safety,rather than public safety itself.In fact,the subjective attitudes of dangerous drivers towards endangering public safety and violating traffic order are inconsistent.As far as the provision is concerned,dangerous driving offenders can only meet the subjective requirements of the dangerous driving crime when they knowingly violate the traffic order and hold a willful attitude towards it.Therefore,the form of his crime can only be criminal intent.The relation between this crime and the crimes of endangering public security is the overlapping of legal provisions.When overlapping legal provi-sions occur,the relevant charges should be determined based on the subjective guilt content of the perpetrator for pub-lic security,and they shall be subject to a heavier punishment.
