摘　　要：对当前频发的滋生在电商平台以打假维权之名行敲诈勒索之实的恶意索赔违法犯罪行为,通过对裁判文书网及Alpha法律智能数据库中相关案例实证研究发现,司法机关在打击此类行为实践中面临着线索发现难、立案难,调查取证固定证据难,违法行为定性、法律适用难等问题。为此应建立共享数据平台固定证据,统一法律规制口径界定索赔行为性质,对恶意索赔行为分类认定,从而建立有效的法律处置机制,以切实遏制当前电商平台中频发的恶意索赔乱象。As for the frequent illegal behaviors of malicious claims and extortion on e-commerce platformsin the name of fighting counterfeits and protecting legal rights,the empirical study of relevant cases inChina Judgments Online and AlphaIntelligent Legal Database shows that judicial organs are faced with difficulties in finding clues,filing cases,fixing evidence,determining the nature of illegal behaviors and applying relevant laws in the practice of cracking down on such cases.For this reason,it is necessary to establish a shared data platform to fix evidence,unify legal regulations to define the nature of claims,classify and identify malicious claims,and establish an effective legal handling mechanism to effectively curb the frequent malicious claims on e-commerce platforms.
