摘 要:教育惩戒在高等教育与基础教育领域是不同的。高校学生惩戒具有多类型的特点,加之当前对学生惩戒的规定存在无差别化的特点,使得惩戒无可操作性的规定作为法律依据。而立法滞后无法应对司法实践中的新要求、惩戒程序尚无全链条式制度保障等一系列因素更加重了高校在惩戒中的困惑,直接导致高校在惩戒学生过程中面临诸多困境,这就需要找准学生惩戒的法律规制路径。一是完善教育立法,夯实学生惩戒的法律依据;二是合理化校规,提高学生惩戒行为的可操作性;三是找准程序定位,完善学生惩戒的程序制度。Educational punishment is different in the fields of higher education and elementary education.The punishment of college students has multiple types of characteristics.Coupled with the current non-discriminatory provisions on student punishment,there is no operational provision as a legal basis.However,a series of factors,such as the lag in legislation,the inability to respond to new requirements in judicial practice,and the lack of a full chain of institutional guarantees for disciplinary procedures,have further exacerbated the confusion faced by universities in the process of disciplinary action,directly leading to many difficulties in the process of punishing students.Therefore,it is necessary to identify the legal regulatory path for student disciplinary action.One is to improve educational legislation and strengthen the legal basis for student punishment.The second is to rationalize school rules and improve the operability of student punishment behavior.The third is to identify the procedural positioning and improve the procedural system for student punishment.
