期货和衍生品交易纠纷调解机制的完善路径

摘　　要：党的十八大以来,完善社会矛盾纠纷多元化解机制成为深化司法领域改革的重要课题。调解与传统的诉讼、仲裁制度相比,具有简便高效的优势,能够有效节约中小投资者的纠纷解决时间和费用,也是保护投资者合法权益的重要一环。《期货和衍生品法》第五十六条亦确立了强制调解制度。文章在借鉴其他国家和地区期货和衍生品纠纷调解机制发展的基础之上,结合我国期货行业现状和《期货和衍生品法》的相关规定,探寻我国期货和衍生品纠纷调解机制的完善路径。Since the 18th National Congress of the Communist Party of China,improving the multi-resolution mechanism of social contradictions and disputes has become an important issue in deepening the reform of the judicial field.Compared with the traditional litigation and arbitration system,mediation has the advantages of simplicity and efficiency,which can effectively save the time and cost of dispute resolution for small and medium-sized investors,and is also an important part of protecting the legitimate rights and interests of investors.Article 56 of the Futures and Derivatives Law also establishes a compulsory mediation system.Based on the development of futures and derivatives dispute mediation mechanism in other countries and regions,combined with the current situation of China’s futures industry and the relevant provisions of the Futures and Derivatives Law,this paper explores the improvement path of China’s futures and derivatives dispute mediation mechanism.
