区块链存证之于刑事电子数据存证困境的突破

摘　　要：刑事电子数据囿于其自身虚拟性、易变性等特点,在证据存证中易出现存储载体破坏、数据失真、完整性损坏等问题。区块链以其防篡改、可溯源的技术优势,破解电子数据存证保真难题,保障了存证中电子数据载体真实性、内容真实性和完整性。电子数据的区块链存证是存证发展的趋势,当前对区块链存证应用机制予以优化,以满足当前及以后刑事电子数据存证的真实性保障的需求。具体可从规则、人才、技术三个方面对区块链存证应用机制予以优化。规则层面,完善电子数据区块链存证规范体系;人才层面,培养复合型法律人才;平台层面,加强存证平台的自身规范建设和构建协同一体区块链存证平台。Criminal electronic data are limited by its own virtual,volatile and other characteristics.In evidence storage,it is easy to appear storage carrier damage,data distortion,integrity damage and other issues.With its technical advantages of tamper-proof and traceability,blockchain has solved the problem of authenticity of electronic data certificates,and guaranteed the authenticity,content authenticity and integrity of electronic data carriers in certificates.Blockchain certificate of electronic data is the development trend of certificate,on the basis of the current block chain certificate,its application mechanism is optimized to meet the current and future needs of the authenticity of criminal electronic data certificate.Specifically,we can optimize the application mechanism of blockchain deposit certificate from three aspects:rules,talents and technology.Improve the standard system of electronic datablock chain deposit certificate at the level of rules;Train compound legal talents;Strengthen the self-standardized construction and build a collaborative blockchain certification platform.
