摘　　要：撤回公诉是检察制度和审判程序中较为薄弱的部分,完善撤回公诉制度对于检法之间的职权平衡及当事人诉讼权益的保障有着很大的影响。由于检法之间“配合有余”、不合理的绩效考核制度及诉讼理念具有倾向性等原因的影响,撤回公诉制度在实践中存在适用范围超限制、功能异化及当事人权利保障不足的问题。对此,一是要严格审查撤回公诉适用事由、加强庭前会议与庭审撤诉处理的衔接;二是要建立科学的检察机关绩效考核指标;三是要强化当事人在该程序中的权利保障,从而在整体上推动撤回公诉制度的规范适用。Withdrawal of public prosecution is the weak part of the procuratorial system and trial procedure,and its perfection has a great impact on the balance of powers between the prosecution and the law and the protection of the litigation rights and interests of the parties.Due to the influence of excessive cooperation between the prosecution and the law,unreasonable performance appraisal system and the tendency of litigation concept,the withdrawal of public prosecution system has some problems in practice,such as ultra-limited scope of application,functional alienation and insufficient protection of the rights of the parties.To improve it,first,we should strictly examine the applicable reasons for withdrawing public prosecution,strengthen the connection between pretrial conference and court trial withdrawal;The second is to establish a scientific performance evaluation index of procuratorial organs;Thirdly,we should strengthen the protection of the rights of the parties in the procedure,so as to promote the normative application of the withdrawal of public prosecution system as a whole.
