摘　　要：新时期,笔迹鉴定作为司法鉴定的重要证据之一,被广泛用于民间借贷、合同纠纷案件的司法鉴定工作中。笔迹鉴定对象非常复杂,以人为观察、分析、对比等经验手段作为依据颇具争议。因此,笔迹鉴定书的法律效力以及是否能够仅凭借笔迹鉴定书认定法律关系的成立,是目前法律研究界共同关注的命题。本文通过对笔迹鉴定的性质进行分析,以我国相关法律法规为依据,分析了笔迹鉴定意见的法律效力,并提出了其在司法鉴定意见证据中的应用方法,旨在促进我国司法鉴定体系的完善。As one of the key evidence,handwriting verification is widely used in the forensic appraisal of private lending and contract disputes.Handwriting verification is based on manual observation,analysis,comparison and other empirical methods,which is quite controversial.Hence,the issues of its legal validity and whether legal relationships can be determined solely by virtue of handwriting verification are of common concern in the current research community.According to relevant laws and regulations in China,this thesis aims to examine the nature of handwriting verification and the legal validity of its appraisal opinions,and proposes methods for its application in the evidence of forensic opinions,aiming to improve the judicial appraisal system.
