摘 要:在能源领域中能源普遍服务是最能彰显公平理念的制度设计,推进能源普遍服务是实现正义的应有之义。在市场经济背景下,尽管理论上政府应当是能源普遍服务的责任主体,但在实践中政府很难直接参与能源普遍服务。我国面临的主要问题是义务和利益相冲突的企业作为法律规定的落实普遍服务的义务主体,与其作为经济学上“理性人”的天然本性难以调和的矛盾。发达国家以及欠发达国家在积极探索能源普遍服务进程中都曾出现类似症结,因此发达国家对此的一些法律制度值得我们参考,但我国基于自己的特殊国情,对于这个问题有着独特的解决路径,如建立能源普遍服务基金制度、在能源服务基础建设方面引入PPP模式、建立能源普遍服务的法律规范体系。The main manifestation of equity in the energy field is universal energy services,and promoting universal energy services is the due meaning of justice in the energy field.Under the background of market economy,theoretically the government should be the responsible subject of universal energy services,it cannot directly participate in universal energy services.The main problem is the conflict between obligations and interests-the contradiction between the enterprise as the subject of obligation to implement universal services stipulated by law and its natural nature as a"rational person"in economics,difficult to reconcile.The developed countries and less developed countries will face such basically consistent sticking points in the process of actively exploring universal energy services,and there are some legal systems in the developed countries that are worthy of our reference,but China has a unique way to solve this problem based on its own special national conditions,such as establishing a universal energy services fund system,introducing PPP mode in energy service infrastructure,and establishing a legal and regulatory system for universal energy services.
