摘　　要：第三方参与生态环境损害赔偿磋商制度是环境救济的一个重要环节,是公私法协同救济生态环境的制度安排。深入推进生态环境治理,构建健全的环境损害救济机制,需在法律救济上明确第三方在磋商中的具体参与途径。在审视7省份磋商办法与十大磋商典型案例的基础上,探究磋商制度中第三方参与存在的问题。通过清晰界定第三方概念、了解第三方实貌,明确其参与功能和法制完善路径,在充分落实第三方环境知情权、环境参与权的基础上,以法规形式固定第三方的监督权和话语权,为多元主体保护生态环境寻找更多的路径。The consultation system of third-party participation in compensation for ecological and environmental damage is an important link in environmental relief,and it is the system arrangement of public and private law to cooperate in the relief of ecological environment.To further improve the ecological environment and build a sound mechanism for environmental damage relief,it is necessary to clarify the specific participation of third parties in the consultation on legal relief.On the basis of examining the consultation methods of seven provinces and ten typical cases of consultation,explore the problems existing in the third party participation in the consultation system.By clearly defining the concept of the third party,understanding the reality of the third party,clarifying its participation function and legal system improvement path,on the basis of fully implementing the third party’s environmental right to know and environmental participation right,the third party’s supervision right and discourse right should be fixed in the form of laws and regulations,and striving to find more ways for multiple subjects to protect the ecological environment.
