摘　　要：现有对康德政治哲学的研究尤为缺少对其整体定位的关注,以至于对作为其政治哲学最终目的的永久和平理念的解读形成了偏差.康德哲学之逻辑框架由要素论与方法论构成,表现为法庭与讼争的隐喻.要素论是对人之诸能力的先天性根源、范围和限度的考察,确立法庭的构成材料;方法论涉及如何运用人之诸能力的理性规划,包括构建法庭的方法与主体参与讼争的方法,并在公共性上具有政治的内涵.康德政治哲学之内在逻辑更偏重于方法论而非要素论,反映在要素论上,仅表现为一种静态的、纯然法权的普遍合法性状态,没有给出更多的内容;反映在方法论上,则指向一种具有普遍合法性的争论与共识循环往复的讼争状态,尽管存在难以克服的理论困境,却在历史的维度显露出其特有的实践品格与现实意义.Existing studies of Kant's political philosophy especially lack attention to its overall orientation,so that a bi-ased interpretation of the idea of permanent peace,which is the ultimate goal of political philosophy,has formed.The logical framework of Kants philosophy is constituted by doctrine of elements and doctrine of methods,expressed in the metaphor of court and litigant dispute.Doctrine of elements is an examination of the innate roots,scope and limits of the human faculties,ie.the constituent materials that establish the court;Doctrine of methods involves the ration-al planning of how to use human abilities,including the way in which courts are constructed and the way in which subjects participate in litigation,and has a political connotation in its public nature.The internal logic of Kant's politi-cal philosophy emphasizes more on doctrine of methods than doctrine of elements.When reflected in the doctrine of el-ements,it only manifests itself as a static,purely right of universal legitimacy that gives no further content;when re-flected in the doctrine of methods,it manifests itself as a state of litigant dispute with a universal legitimacy of argu-ment and consensus that,despite the insurmountable theoretical dilemmas,reveals its unique practical character and realistic significance in the historical dimension.
