摘 要:在全球数据规模化、一体化和前沿化等共同作用和疫情衍生影响下,难以通过传统的双边执司协作及时有效地完成跨境数据取证。基于一揽子计划的欧盟框架或基于《云法案》及其衍生协议的美国框架等单边扩散的治理方案亦无法阻却跨境数据取证治理模式的功能失衡。亟待结合信息社会中数据证据的具体特点,有针对性地完善跨境数据取证治理的多边规则并逐步构建统一协调且监管完善的治理机制,营建基于共同利益的合作、强调域内立法的域外适用、限制跨境数据取证具体适用以及坚持跨境数据正当取证的治理模式,切实维护数据主权、社会安全与不同主体的合法权益,促进数字经济健康有序发展。Under the combined effects of global data scaling,integration and frontiers,as well as the derivative impact of COVID-19,it is difficult to timely and effectively complete cross-border data evidences collection through traditional bilateral law enforcement cooperation and judicial assistance.Unilateral controlling schemes,such as EU framework based on a package plan or US framework based on Cloud Act and its derivative agreements,cannot prevent the functional imbalance of governing cross-border data evidence collection.It is urgent to combine specific characteristics of data evidence in information society,improve multilateral rules for governing cross-border data evidences collection in a targeted manner,and gradually build a unified,coordinated,and well regulated governance mechanism,consolidate cooperation based on common interests,emphasize the extraterritorial application of legislation within the domain,restrict the specific application of cross-border data evidences collection,and adhere to the governance model of legitimate collection of cross-border data evidences,effectively safeguard data sovereignty,social security and legitimate rights and interests of different entities,and promote the healthy and orderly development of digital economy.
