以民事合同方式完成行政任务的可能性——以“永佳纸业案”为例的考察

摘　　要：行政协议进入行政诉讼受案范围后,行政协议司法解释确定的识别公式为“具有行政法上权利义务内容=行政协议”,并未考虑以民事合同方式完成行政任务的可能性。然而,该可能性完全可以成立于行政实践中的具体事实构成上。行政法学理中,尽管存在不同的研究路径,实际上均承认以民事合同方式完成行政任务的可能性。实体性行政法律规范中虽未予明确,但由于民事法律规范向来予以认可,因此该可能性亦可在成文规范体系中成立。从法律制度构建这一更为宏观的层面上来看,亦应对以民事合同方式完成行政任务持开放包容的态度。因此在识别行政协议的过程中,应考虑以民事合同方式完成行政任务的可能性。即便行政机关与相对人之间订立的协议“具有行政法上权利义务内容”,该协议仍有可能被定性为民事合同。After the administrative agreement entered the scope of accepting cases in administrative litigation,the judicial interpretation of administrative agreement stipulates that the identification formula of administrative agreement is“the content of rights and obligations in administrative law=administrative agreement”,without considering the possibility of completing administrative tasks in the form of civil contract.From the actual situation of administrative practice,this possibility can be established in fact.In the theory of administrative law,although the existing research options are different,in fact,they all admit the possibility of accomplishing administrative tasks in the way of civil contract.Although it is not clear in the substantive administrative legal norms,this possibility can also be established in the written norm system because the civil legal norms have always been recognized.From the more macroscopic level of legal system construction,we should also be open to completing administrative tasks by civil contract.Therefore,in the process of identifying administrative agreements,we should consider the possibility of accomplishing administrative tasks by civil contract.Even if the agreement between the agency and the counterpart“has the content of rights and obligations under administrative law”,the agreement may still be characterized as a civil contract.
