摘　　要：对于罪错未成年人,无论是从法理方面还是从生活常识方面来说,其监护人都是难辞其咎的。但在实际生活中,究竟应该如何追究监护人的责任,不仅立法上存在语言表达笼统含糊、有职责要求而无失职后处罚方式的具体细则规定等疏漏,在司法实践中也存在配套措施不完善、该作为而不作为之类的问题。应当在明确监护职责、细化责任要求、建构完整的追责体系,以及强化追责主体的责任感、提高执法人员业务水平和工作能力等方面作出努力。The guardians of the delinquent minors,both from the legal aspect and from the aspect of common sense,are to be blamed.However,in actual life,as for how to claim the accountability of the guardian,there are not only omissions in legislation,such as vague language expression,specific rules and regulations on duty requirements without post dereliction of duty punishment,but also problems in judicial practice,such as imperfect supporting measures and inaction.Efforts should be made to clarify guardianship duties,refine responsibility requirements,construct a complete accountability system,as well as strengthen the sense of responsibility of the subject of accountability,and improve the operational level and working ability of law enforcement officers.
