量刑建议“检察主导”的逻辑解构与制度重塑

摘　　要：针对认罪认罚案件,量刑建议制度采用“检察主导”模式。“检察权决定”和“检察权裁判”分别主导量刑建议的生成与采纳。“检察主导”的形成既与认罪认罚从宽制度的本质属性与功能定位有关,也与检察机关在刑事诉讼中的职权行使原则和角色定位相关。“检察主导”不仅契合我国刑事诉讼职权主义传统和“层控式”结构,而且可以保证控辩合意的兑现、激励被追诉人认罪认罚以及提升诉讼效率。但是,当前“检察主导”也存在无法切实保障被追诉人对量刑建议的“有效同意”、容易僭越司法最终裁决原则等弊端。对此,检察机关应通过开示主要证据、实行有限抗诉、强化释法说理等,重塑“检察主导”下的控辩、控审关系,避免“检察主导”的失范化。For the case of guilty plea,the sentencing suggestion system adopts the"prosecutorial leading"model."Prosecutorial decision"and"prosecutorial judgment"lead the generation and adoption of sentencing suggestions respectively.The formation of"prosecutorial leading"is not only related to the essential attributes and functional positioning of the lenient system of guilty plea,but also related to the principle of the prosecutorial organ's exercise of authority and role positioning in criminal proceedings.The prosecutorial leadership not only conforms to our country's criminal procedure official-functions tradition and the"layered control type"structure,but also can guarantee fulfillment of agreement on charge and debate,encourage guilty plea of the prosecuted and improve litigation efficiency.However,the current"prosecutorial leading"also has the disadvantages of failing to guarantee the"effective consent"of the person prosecuted to the sentencing suggestion and easily arrogated the principle of judicial final decision.In this regard,the prosecutorial organ should remodel the relationship between prosecution,defense and trial under the"prosecutorial leadership"by revealing the main evidence,implementing limited protest and strengthening the interpretation of the law,so as to avoid the maladjustment of"prosecutorial leadership".
