摘　　要：《村民委员会组织法》在保障村民自治、推动农村基层民主建设、维护村民合法权益、激发农村活力等方面产生了积极效果,但实施中也出现乡—村关系模糊、村务监督薄弱、权利救济不完善、法律责任缺乏等问题,需要根据村组发展的实际情况对《村民委员会组织法》进行修改。修改《村民委员会组织法》应以健全中国共产党领导下充满活力的基层群众自治制度为核心,秉持坚持与完善村民自治制度的理念,坚持村民自治制度,保障村民民主权利;在修改策略方面,要总结实践经验、面对现实问题,体现时代要求、推动乡村发展,深化填补并重、错位领域纠偏,法律协调统一、吸纳良善规范。在修改基点方面,应坚持村民自治本位、突出村民自治主体、善用村民自治资源、拓宽村民自治渠道、促进村民自治深嵌等。The Organic Law of Villagers'Committee has produced positive effects in guaranteeing villagers'autonomy,promoting the construction of grassroots democracy in rural areas,safeguarding villagers'legitimate rights and interests,and stimulating rural vitality.It is necessary to amend the Organic Law of Villagers committee according to the actual situation of rural development for the reasons of vague provisions on the relationship between township and village,weak supervision of village affairs,and imperfection of legal responsibility and right relief.In amending the Organic Law of the Villagers'Committee,we should fully adhere to and perfect the villagers'self-governance,adhere to the villagers'self-governance system and protect the villagers'democratic rights.In terms of revising strategies,it is necessary to sum up practical experience,face practical problems,reflect the demands of the time,promote rural development,pay equal attention to filling and supplementing,correct misaligned fields,coordinate and unify laws,and absorb policy norms.In terms of revising basis,we should insist on restoring the standard of villager autonomy,highlighting the main body of villager autonomy,making good use of villager autonomy resources,broadening the channels of villager autonomy and promoting the deep embedding of villager autonomy.
