我国兴奋剂调查机制的现实困境与完善进路

摘　　要：在反兴奋剂工作开展中,仅凭兴奋剂检查机制难以实现对隐蔽性违规行为的有效查处,也无法确保检查结果的实体真实并担保检查程序自身的正当性。兴奋剂调查机制则可以弥补上述短板。只有将两者有效结合,方能有力提升兴奋剂违规查处的工作质效。我国兴奋剂调查机制虽已建构,但依然存在制度规范性不足、情报信息衔接不畅、调查活动监督不力的现实困境。鉴于此,应从细化调查机制相关规范、构建高效的情报互通机制、强化调查活动的监督制约三个方面来推进兴奋剂调查机制的完善,推动反兴奋剂工作向纵深发展。In the development of anti-doping work,it is difficult to effectively investigate and deal with hidden violations by relying on the doping control mechanism alone,nor can it ensure the authenticity of the test results and guarantee the legitimacy of the testing procedures themselves.The doping investigation mechanism can make up for this.Only by combining the two effectively can we effectively improve the quality and efficiency of the investigation and punishment of doping violations.Although the doping investigation mechanism in China has been established,there are still predicaments,such as insufficient standardization of relevant regulations,poor connection of information mechanisms,and inadequate supervision of investigation activities.In view of this,the improvement of the doping investigation mechanism should be promoted from three aspects:refining the relevant norms of the investigation mechanism,building an efficient information exchange mechanism,and strengthening the supervision and restriction of investigation activities,so as to promote the in-depth development of anti-doping work.
