司法官选任制度的演进、检视与完善——基于海峡两岸司法改革比较视角

摘　　要：司法官是司法体制中关于“人”的制度。司法官选任制度完善与否,不仅直接关系着司法官群体的素质与修养,更直接影响着国家司法职能的发挥程度。以法官法、检察官法的立法、修改与“法考”为主线,回顾内地司法官选任制度的发展历程,进而采用比较的研究方法,通过海峡两岸比较的视角,可知内地存在着司法官选任渠道未能进一步拓宽、未能区分选拔对象、对“优秀”条件的规定不够明确、职业保障不足以支撑高标准的职业准入门槛等问题。建议拓宽从其他法律职业群体选拔优秀司法人才渠道,更加细化规定从律师、法学专家中选拔司法官条件,提升司法官的职业尊荣感,增强其职业保障,从而进一步完善内地司法官选任制度。The judicial officer is the system of"people"in the judicial system.The judicial officer selection system is perfect or not is not only directly related to the quality and cultivation of the judicial officer group,but also affects the degree to which the country's judicial functions are played.Taking the legislation,revision and"legal examination"of the Judges Law and the Procurators Law as the main line,this paper reviews the development process of the judicial officer selection system in China's mainland,and adopts the comparative research method from the perspective of cross-strait comparison.It finds that in China's mainland there are problems such as failure to further broaden the channels for judicial selection and appointment,failure to distinguish between candidates,lack of clarity on"excellence",and the failure of occupational security to support the high standard of occupational entry thresholds.It is suggested to broaden the channels for selecting outstanding judicial talents from other legal professional groups,specify the conditions for selecting judicial officers from lawyers and legal experts,enhance the sense of professional honor of judicial officers and improve their occupational security,so as to further improve the judicial selection and appointment system in China's mainland.
