摘 要:互联网让世界变平,也让雇佣关系的认定变得日趋复杂。以“智能主义”为主导的智能平台的组织形态与福特主义、后福特主义显然不同,智能平台组织正在由传统的垂直型向水平型发展,雇员开始从过去的“厂区人”“固定人”向“移动人”和“共享人”转变,工作场所流动化、工作时间碎片化已成常态。这不仅导致雇佣关系的从属性减弱,也导致雇员之间的联系性日趋松散和微文本化,雇员之间组织性日趋弱化。但另一方面,相对于拥有强大算法的网络智能平台运营商,雇员各项权益的保障又离不开集体组织的力量和智慧,智能平台雇员组建工会是集体劳动权行使的必然要求。雇员的主体身份界定不明、集体协商机制缺位以及难以组织等问题,需要通过明确智能平台雇员的工会会员资格、完善集体协商制度、创新工会组织形式等途径加以解决。The Internet has flattened the world and complicated the definition of employment.The organizational form of the intelligent platform dominated by“intelligence”is obviously different from that of Fordism and Post-Fordism.The organization of intelligent platform is developing horizontally rather than vertically.Employees are beginning to change from the“factory people”and“fixed people”in the past to“mobile people”and“shared people”.The mobility of the workplace and the fragmentation of working hours have become the norm,which not only leads to the weakening of the subordination of the employment relationship,but also leads to the increasingly loose and micro-textualized connection between employees,and the weakening of the organization between employees.However,compared with the operators of intelligent platform with powerful algorithms,the protection of employees’rights and interests is inseparable from the strength and wisdom of collective organizations.The formation of trade unions by employees of intelligent platform is an inevitable requirement for the exercise of collective labor rights.Under the intelligent platform economy,there are some problems,such as the unclear definition of the subject identity of employees,the absence of collective consultation mechanism,the difficulty of organizing and so on.It is necessary to solve these problems by clarifying the trade union membership of platform employees,improving the collective consultation mechanism and innovating the form of trade union organization.
