摘　　要：随着快递行业的快速发展,快递员非法占有快递包裹行为成为现阶段发生频率比较高的案件。在司法实践中关于快递员非法占有快递包裹的刑法定性问题始终是刑法规制的重要内容。刑法修订后,关于快递员非法占有快递包裹这一行为有新的司法认定,针对快递服务的不同环节以及相同环节不同情况等行为都有新的判定。本文主要是刑法视角下快递员非法占有快递包裹的司法认定,通过对两个不同刑事案例以及判决结果的分析,归纳总结案例存在争议的焦点,从快递员职务内容和职务分类两方面入手,快递运输的不同阶段中快递员非法占有快递行为进行刑法定性分析,最后结合具体刑事案例对刑法视角下快递员非法占有快件行为进行司法认定,旨在丰富我国现有的关于快递员非法占有快递包裹行为的理论内容,加快推进我国刑法进程。With the rapid development of the express industry,the illegal possession of express packages by couriers has become a relatively frequent case at this stage.In judicial practice,the criminal characterization of the illegal possession of express parcels by couriers has always been an important part of criminal law regulation.After the revision of the Criminal Law,there has been a new judicial determination on the illegal possession of express packages by couriers,as well as a new judgment on different aspects of express services and different situations in the same link.This article is mainly about the judicial determination of the illegal possession of express parcels by couriers from the perspective of criminal law.Through the analysis of two different criminal cases and the results of the judgments,the focus of the disputes in the cases is summarized,and the qualitative analysis of criminal law is made on the illegal possession of express parcels by couriers in different stages of express transportation,starting with the content and classification of the posts of couriers,Finally,the judicial determination of the illegal possession of express parcels by couriers from the perspective of criminal law is carried out in combination with specific criminal cases,aiming to enrich the existing theoretical content of the illegal possession of express parcels by couriers in China and accelerate the process of criminal law in China.
