刑事速裁上诉制度刍议

摘　　要：刑事速裁被告人的上诉权关乎认罪认罚从宽制度的正当化基础。限制、剥夺论未实现提升司法效率之目的且加重控辩失衡,导致该理论不具有正当性;而保留速裁案件被告人的权利型上诉权符合以审判为中心的诉讼理念和中国司法实践,具有制衡检察权、实现轻罪案件刑罚轻缓化等司法价值和功能。速裁上诉程序的完善措施包括落实审判中心主义内涵、明确二审之法律救济功能;重新解读全面审查及上诉不加刑原则,并引入无害理论;同时明确书面审查审理方式,规范二审裁判规则之适用等。相关配套建设包括构建社会公共服务机制、调整轻罪刑罚结构及统一监禁刑执行体系和检察机关违约制裁措施等。The defendant’s right of appeal for quick criminal convictions is related to the justification of the leniency system for admitting guilt and accepting punishment.The theory of restriction and deprivation fails to improve judicial efficiency and aggravate the imbalance between prosecution and defense,which makes the theory unjustifiable.While the preservation of the defendant’s right to appeal in expedited judgment cases conforms to the trial-centered litigation concept and judicial practice in China,and has the ability to implement the spirit of the Constitution,the realization of light crime cases and other judicial values and functions.The improvement measures for the expedited appeal procedure include implementing the connotation of trial centralism,clarifying the core functions of second-instance relief;reinterpreting the principle of comprehensive review and appeal without penalty,and introducing harmless theory;at the same time,clarifying the written review and trial method,and standardizing the types of second-instance judgments,etc.Relevant supporting construction includes the establishment of sanctions for breach of contract by procuratorial organs,adjustment of the structure of misdemeanor punishment,and a unified execution system for imprisonment.
