摘 要:生态修复非刑罚措施是司法机关参与我国生态文明建设的重要手段之一,对修复因环境犯罪而致损的生态环境具有重大意义。研究基于江西生态文明试验区自批复成立以来的近8000件环境刑事案件,分析了我国适用生态修复非刑罚措施的情况。研究发现:司法机关在适用生态修复非刑罚措施过程中存在实施力度小、评估成本高、资金来源单一、监督困难等问题。基于此,需要从完善生态修复非刑罚措施的相关制度、降低生态修复的评估成本、拓展生态修复资金来源、完善生态修复监督机制等方面完善我国生态修复非刑罚措施的司法适用。Non-penal measures for ecological restoration are one of the important means for judiciary authorities to participate in the construction of ecological civilization in China,and are of great significance in restoring the ecological environment damaged by environmental crimes.Based on nearly 8,000 environmental criminal cases since the establishment of the Jiangxi Ecological Civilization Pilot Zone,the study analyzes the application of non-penal measures for ecological restoration in China.Research has found that there are problems in the application of non-penal measures for ecological restoration by judicial authorities,such as low implementation efforts,high evaluation costs,limited sources of funds,and difficulties in supervision.Based on this,it is necessary to improve the judicial application of non-panel measures for ecological restoration in China from the aspects of improving relevant systems for ecological restoration,reducing the evaluation cost of ecological restoration,expanding the sources of ecological restoration funds,and improving the supervision mechanism for ecological restoration.
