检察视阈下“督促监护令”与“强制家庭教育指导”制度之完善

摘　　要：未成年人家庭保护对于未成年人健康成长至关重要。未成年监护人应当切实履行监护职责,正确实施家庭教育,以减少和避免因监护不当导致未成年人实施严重不良行为或者犯罪行为,同时降低未成年人受到违法犯罪侵害的可能。检察机关作为法律监督机关,应积极通过“督促监护令”或者“强制家庭教育指导”等制度的落实开展监护监督。要正确处理制度之间的关系,寻求应对之策以解决两项制度在落实过程中存在的问题。The protection by the family plays a vital role for juveniles.Tutores of law must fulfill their duties of guardianship and implement family education correctly to reduce and avoid juvenile delinquency and crime,victimization of minors for inappropriate family education.As the legal Supervision Organ,the Procuratorial Oragn should carry out the system of“the legal order of supervising custody”and“the mandatory family education guidance”to implement supervision system of guardianship.The Procuratorial Oragn should deal with relations between the above systems and other relevant procuratorial systems to seek countermeasures to solve the problems that exist in the process.
