摘 要:剥夺政治权利的执行主体在实践中经历过在司法行政机关与公安机关之间摆动的过程,从职能定位、制度安排和刑事执行权专业化等角度上看,司法行政机关更适合作为执行主体;在执行方式上,应当以权利剥夺为核心重新考量和构建剥夺政治权利的执行方式,并完善奖惩等配套机制,确保对剥权犯的合理有效监管;在法律监督上,检察机关要坚持依法能动履职,紧抓“接收”“监管”“解除”三个环节,全面加强对剥夺政治权利的法律监督,推动进一步完善相关规定。In practice,the executive subject of the deprivation of political rights has experienced a process of swinging between the judicial executive branch and the Public Security Bureau.The judicial executive branch is more suitable as the subject of enforcement,and the way of enforcement should be reconsidered and constructed with the deprivation of political rights as the core.In terms of legal supervision,the procuratorial organs should perform their duties in accordance with the law,strictly grasp the three links of“receiving”,“supervising”and“relieving”,comprehensively strengthen legal supervision over the deprivation of political rights,and promote the further improvement of relevant regulations.
