等效原则:在线民事诉讼合法性的规范基础

摘　　要：等效原则确立了在线民事诉讼合法性的规范基础,具有指引在线民事诉讼制度设计的功能,也是程序选择权的重要基础。其核心要义在于在线民事诉讼程序的运行应当保障司法公正的实现、在线民事诉讼与线下民事诉讼具有功能等值性以及在线实施的民事诉讼行为不需要线下重新实施等方面。此外,等效原则还调整着民事诉讼行为的实施。等效原则要求保障在线民事诉讼的质量;当在线民事诉讼行为存在瑕疵时,需要进行补正才能符合等效原则的要求;面对网络技术故障造成的当事人在线民事诉讼行为迟误,应当允许当事人补行相应民事诉讼行为,补行的民事诉讼行为应当被视为是及时作出的。The principle of equal legal effect is the basic rule for the legality of online civillitigation.Ithas the function of guiding the design of online civil litigation system,and is also the important basis of procedure option right.The core meaning of the principle reflects in the following aspects.Firstly,online civil litigation should ensure the realization of justice;secondly,online civil litigation and scene civillitigation have equivalent functionality;thirdly,the principle also regulates the implementation of civil procedural actions.If the civil pro-cedural actions have been implemented online,there is no need to be re-implemented on the scene.Addition-ally,this principle regulates the implementation of civil proceduralactions which requires that the quality of on line civil litigation should be guaranteed.When there are flaws in online procedural actions,it is necessary to make corections to comply with the principle of equal legal ffect;if the delay of parties'online civil procedural actions is caused by technical failures,the parties should be allowed to make up the coresponding civil proce-dural actions,and the supplementary civil procedural actions are deemed to be implemented timely.
