摘  要:农村土地抵押的创制动因在于实现土地权利的资本化,“三权分置”下农村土地权利抵押亟待设置土地银行作为抵押权人,以解决抵押物流动变现、金融风险管控和农民土地财产权益保障等难题。中国特色的农村土地银行,性质上为政策性金融机构,其以土地抵押贷款为核心业务,组织架构上可以中国农业发展银行为主体设置相应机构。抵押权运行时,土地权利主体通过农村土地银行设定抵押融资贷款,抵押权变现处置则由土地权利收储与市场交易平台将土地权利予以市场化流转,以确保抵押权实现。The reason for the creation of rural land mortgage is to realize the capitalization of land rights.The mortgage of rural land rights under the"separation of three rights"urgently needs to set up a land bank as the mortgagee,so as to solve the problems of mortgage liquidity and realization,financial risk management and control in the operation of the system and farmers problems.Real problems such as the protection of land and property rights and interests.Rural land banks with Chinese characteristics define policy financial institutions in nature,and take land mortgage loans as their core business.In terms of organizational structure,the Agricultural Development Bank of China can be the main body to set up corresponding institutions.When the mortgage right is in operation,the right subject sets up the mortgage financing loan through the rural land bank,and the realisation and disposal of the mortgage right is carried out by the land rights storage and market trading platform to market the rural land right to ensure the realization of the mortgage right.
