新形势下水电工程建设征地农村宅基地处理研究

摘　　要：农村宅基地是农民的重要财产,水电工程建设征收农民的宅基地涉及对农村移民拥有宅基地合法权益保护问题。在近些年的水电工程建设征地移民安置规划设计和安置实施中,既缺乏对农村移民宅基地补偿或处理的技术标准,也出现了部分不平衡、不合理的现象。为妥善解决水电工程建设征地涉及农村宅基地补偿处理问题,研究在介绍宅基地相关法律法规和管理制度基础上,结合我国水电工程建设征地涉及农村宅基地的处理实践情况,提出新形势下按照新址规划宅基地面积与相应征占原有宅基地面积进行平衡的处理思路和相关建议,以期对下一步的征地补偿政策和移民安置规程规范的完善提供参考。Rural homestead is an important property of farmers.The acquisition of rural homestead for hydropower project construction involves the protection of legitimate rights and interests of rural immigrants.In recent years,there is no technical standard for the compensation or treatment of rural migrant's homestead in the planning,designing and implementation of land acquisition and resettlement for hydropower project construction,and some unbalanced and unreasonable phenomena have appeared.In order to properly solve the problem of compensation for rural homestead involved in land acquisition for hydropower project construction,relevant laws,regulations and management systems of homestead are firstly introduced,and then the treatment idea of balancing the planned homestead area and the corresponding original occupied homestead area and relevant suggestions are put forward under the new situation in combination with practical situation of rural homestead in China,in order to provide reference for the improvement of land acquisition compensation policy and resettlement regulations in the future.
