摘　　要：我国台湾地区在2020年开展了为期三年的公共借阅权试办计划,试办计划在两个试办图书馆进行,该计划对符合条件的创作者和出版者创作和出版的纸质图书作品进行补偿。随着第一年试办期的结束,补偿金总体发放过低的实施结果反映了该年度试办期存在申请手续过于繁琐、认定标准存有异议以及借阅图书偏好明显等问题。通过分析台湾地区公共借阅权试办计划下的“立法”模式、补偿规则、具体规定和实施进展存在的不足,以此为今后协调内地与台湾地区开展公共借阅提供相关经验。A three-year public lending rights pilot program was launched in Taiwan,China in 2020.The scheme was conducted in two pilot libraries.It compensates eligible creators and publishers for works created and published in paperbacks.As the first year of the trial period came to an end,the results of the implementation of the overall underpayment of compensation reflected problems such as overly burdensome application procedures,disagreements over the criteria for recognition,and a clear preference for lending books during the trial period.The article analyses the shortcomings of the"legislation"model,compensation rules,specific regulations and implementation progress under the program for public lending rights in Taiwan region,to provide references for the future harmonization of public lending rights in Chinese outback and Taiwan region.
