摘 要:在发表《正义论》之后,罗尔斯在晚年发表《万民法》,对全球正义做了一元论解读。他提倡人民主体性和万民法原则,怀疑全球正义与合理多元论的相容性,尝试建构以万民(peoples)为主体的“现实乌托邦”,寻求国际人道主义援助义务的折衷方案。罗尔斯的万民法学说虽为全球正义研究提供了理论参照,却没有认真对待全球正义实践诉求。扬弃罗尔斯万民法学说,全人类共同价值理念将为探讨全球正义提供新的基点。由此出发,消解国际现实主义,追求全人类共同价值,寻求实现全球正义的多种可能形式,全人类共同价值理念将为全球正义实践提供一个更加合理的理论框架。After A Theory of Justice,Rawls published The Law of Peoples in his later years,which made a interpretation of global justice as monism.He endorsed liberal and decent peoples as subjectivity and the principles of justice among them,doubted the compatibility of global justice and reasonable pluralism,tried to construct a“realistic utopia”constituted by liberal and decent peoples,and sought a compromise solution for the obligation of international humanitarian aid.Rawls’s theory of the Law of Peoples provides theoretical reference for the study of global justice,but it does not seriously treat the practice of global justice.By criticizing this view,the idea of the Common Value of all Mankind will provide a new basis for the discussion of global justice.Take this as the base,international realism should be dispelled,common values of mankind should be pursued,and various possible forms of global justice should be sought.This idea will provide a more reasonable theoretical framework for the practice of global justice.
