摘 要:《劳动法典》研究目前除关注宏观性议题外,亦应聚焦专编做体系布局与核心制度构成研究。编纂而非汇编的《劳动法典》宜采用部门“潘多克顿式”立法。集体劳动法的集体性、民主性、自治与规制的混合性等价值共性是决定其能否独立成编及其编章内容的法理基础,而该编的法典化亦受法典整体立法取向与立法规划的约束与影响。集体劳动法编的立法结构需对《工会法》与《劳动法典》的关系处理、集体合同的编章安排、民主管理制度与集体劳动法编的融合,以及集体争议处理规则的体例安排做重点回应。在未来劳动法“从属性”逻辑不断遭遇冲击的背景下,集体劳动法编亦需对相关特殊群体和用工关系在适用规则与调整内容上予以革新性规范。At present,the study of the Labor Code should not only focus on the macroscopic issues,but also focus on the layout of the system and the core system of every part.The Labour Code,which is assembled rather than compiled,should adopt sectoral“Pendocton”legislation.The value commonalities of collective labor law,such as collectivity,democracy,and combination of autonomy and regulation,are the legal basis for determining whether it can be independently compiled and the content of its parts and chapters.The codification of the part is also constrained and influenced by the overall legislative orientation and legislative planning of the code.The legislative structure of the collective labor code needs to focus on the relationship between the Trade Union Law and the Labor Code,the arrangement of the collective contract,the integration of the democratic management system and the collective labor code,and the arrangement of the collective dispute handling rules.Under the background of the constantly encountering shocks of the“subordinate”logic of labor law in the future,collective labor law also needs to innovate the applicable rules and adjustment contents of relevant special groups and labor relations.
