摘 要:娱乐法专业起源于美国,以培养娱乐法律师及法律专业人才为目标,以其教学中注重应用性和实践性闻名。法学教育改革后,我国娱乐法教育在理论阐述方面取得了长足的进步,但法律诊所作为法学实践教学的重镇却不被重视。美国排名前六娱乐法名校法律诊所具有明显特征:课程以实操为主,专门为娱乐法专业设有3~6门不同法律诊所课程,皆把课程核心放在侵权法、合同法、知识产权法等上,涉及音乐、体育、影视行业。分析美国娱乐法专业法律诊所课程体系构建,其突出教学体系的实践性、产出导向性、高阶性,其灵活的开课形式,以学生为中心的理念,不仅对我国高校的娱乐法专业法律诊所有着积极的意义,甚至对中国法学院所有专业的法律诊所都有积极的借鉴意义。The major of entertainment law originated in the United States,with the goal of cultivating entertainment law lawyers and legal professionals,and is known for its emphasis on application and practice in its teaching.After the reform of legal education,China’sentertainment law education has made great progress in theoretical elaboration,but attention has been less paid to legal clinics as the mainstay of legal practice teaching.The top six entertainment law schools in the United States have distinctive features of legal clincis:the courses are based on practical operations,and there are 3-6 different legal clinic courses for the entertainment law majors,all of which focus on tort law,contract law,and intellectual propertylaw,etc.,involving music,sports,film and television industries.This paper analyzes the construction of the legal clinics curriculum system for entertainment majors in the United States,emphasizing practicality,output orientation,and high-level natureof the teaching system,flexibility of the forms of the courses,and the student-centered concept,all of which convey positive meaning not only for the legal clinics of entrtainment law majors in Chinese universities,butalso for the legal clinics of all majors in the Chinese Law Schools.
