从“神灵规约”向当代村规民约的曲折嬗变——基于滇东南L村基层组织领导村民制定完善村规民约的实践考察

摘　　要：改革开放以来,村规民约在开展村民自治实践与乡村社会治理中发挥出积极作用,不仅得到党中央的肯定、支持与鼓励,还在一系列中央文件中提及,开启党通过农村基层党组织领导村民制定完善村规民约的实践历程。在我国广大农村地区,尤其是偏远民族地区,传统村规民约大多由民间信仰的礼仪禁忌(即“神灵规约”)演变而来。文章通过对滇东南L村从“神灵规约”向当代村规民约曲折嬗变的实践考察,试图为探究农村基层组织在领导村民制定完善村规民约实践过程中如何对传统村规民约进行扬弃与超越提供一些参考与借鉴。Since the reform and opening-up,village regulations and folk conventions have played an active role in the practice of villagers'self-government and the governance of rural society,which has not only been affirmed,supported and encouraged by the party central committee,but also mentioned in a series of central documents,start the party through the rural grass-roots party organizations to lead the villagers to formulate and improve the practice of village rules and conventions.In the vast rural areas of our country,especially in the remote ethnic areas,most of the traditional village rules and regulations are derived from the ritual taboos of the folk beliefs(that is,the“Rules of the gods”).Through the practical investigation of the tortuous transmutation of L village in the southeast of Yunnan from the“Spirit Regulations”to the contemporary village regulations and folk conventions,this paper tries to provide some reference and reference for the rural grass-roots organizations on how to sublate and transcend the traditional village rules and conventions in the process of leading the villagers to make and perfect the village rules and conventions.
