摘 要:商品房预售合同登记备案已经成为商品房交易的必经环节,但相关制度并未将其纳入不动产登记范畴,预售合同登记备案的性质、效力、功能亦无明确界定,登记备案是否可诉以及一房多卖情况下买受人权利顺位等纠纷,理论界存在争议,实务中裁判不一。应完善制度顶层设计,将登记备案主管部门归口到不动产登记部门,明确登记备案的性质及适用范围,规范法律程序。The registration and filing of the pre-sale contract of commercial housing has become a necessary part of the education of commercial housing,but it has not been included in the scope of real estate registration in the relevant system.The nature,effectiveness and function of the registration and filing of the pre-sale contract have not been clearly defined.Whether the registration and filing can be sued and the buyer’s right sequence in the case of one house sold to more than one have been disputed in the theoretical circles,and the judgment in practice is also different.We should improve the top-level design of the system,centralize the registration and filing authorities to the real estate registration departments,clarify the nature and scope of registration and filing,and standardize legal procedures.
